Overview

These Terms of Use are incorporated by reference into your BioWorldIndia Services Agreement.

Your Services may be suspended or terminated for violation of these Terms of Use in accordance with your Agreement with BioWorldIndia.

Capitalised terms used in these Terms of Use shall have the meaning given in your BioWorldIndia Services Agreement.

Purpose

The purpose of these Terms of Use is to enhance the quality of the Services and to protect BioWorldIndia Clients from illegal, irresponsible or disruptive activities. These Terms of Use apply to each Client and its Personnel who obtain Services from BioWorldIndia. Each User shall use common sense and good judgment in connection with their use of the Services, having specific regard to how their use may affect others

Access and Limited Commitment

Your organisation’s access to the Services is contingent upon the agreed Fees being paid in accordance with the BioWorldIndia Services Agreement.

Acceptable Use

You must use the Services in a responsible manner. You must not attempt to breach or circumvent Services’ security (Hacking) or use the Services in connection with any Hacking activities. In addition, you must not use the Services to:

  • Access data that you are not authorised to;
  • Provide access to an individual without appropriate authority
  • Utilise the Services for a client other than that named in the BioWorldIndia Services Agreement;
  • Breach any law, third party rights or any applicable codes or regulations;
  • Send unsolicited messages;
  • Mislead or deceive;
  • Engage in any conduct that is likely to result in retaliation against BioWorldIndia, its officers or other agents, including behaviour that results in any server being the target of a denial of service attack (DoS);
  • Post or transmit information that infringes the rights of a third party, including the right of privacy or publicity;
  • Cause the spread of a virus or another harmful object;
  • Post or transmit junk mail, “spam” or “chain letters”;
  • Collect or store personal data about others without permission;
  • Promote in any way illegal or unwelcome activities; or
  • Undertake promotions or commercial activity.

No Modification

You must not undertake, cause, permit or authorise the modification, creation of derivative works, translation, reverse engineering, decompiling, separation, disassembling or hacking of the whole or part of the Services.

Limited License

The Materials on this Services are protected by copyright and other applicable laws. Unless otherwise stated, all Materials are the property of BioWorldIndia and its licensors. Any rights not expressly granted are reserved. Unless expressly provided herein or in accordance with copyright law, you are only permitted to print and download extracts from the Services (excluding Data Reports) on the following basis:

  • No Personal Information is contained in the extracts;
  • No documents or related graphics on the Services are modified in any way;
  • No graphics on the Services are used separately from accompanying text;
  • No third party or end user licenses are breached; and
  • BioWorldIndia’s copyright and trade mark notices appear unobscured in all copies.

Offensive Content

You may not publish, transmit or store on or via the Services any content or links to any content that BioWorldIndia reasonably believes:

  • Constitutes, depicts, fosters, promotes or makes reference in any manner to acts of sexual nature;
  • Is excessively violent, incites violence, threatens violence or contains harassing content or hate speech;
  • Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
  • Is defamatory or violates a person’s privacy;
  • Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security or interferes with an investigation by law enforcement;
  • Improperly exposes trade secrets or other confidential or proprietary information of another person;
  • Is intended to assist others in defeating technical copyright protections;
  • Infringes another person’s copyright, trade or service mark, patent or other property right;
  • Promotes illegal drugs, violates export control laws, relates to illegal gambling or illegal arms trafficking
  • Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or BioWorldIndia; or
  • Is otherwise malicious, fraudulent or may result in retaliation against BioWorldIndia by offended viewers.

Notification of Infringement of Rights

You should notify BioWorldIndia immediately of any breach of this notice or infringement of Intellectual Property Rights. You should notify by email to rajeev@BioWorldIndia.com
